"Tiffany versus eBay" posted by ~Ray
Posted on 2008-01-16 03:55:49

NEW YORK (Reuters) - A lawsuit by jeweler Tiffany & Co (TIF. N) against eBay (EBAY. O) brought under trademark law is set to open on Tuesday and could affect online auctions of luxury products. Tiffany sued eBay in 2004 in Manhattan's U. S. District Court claiming the online auctioneer had aided violations of jeweler's trademarks by letting counterfeit items be sold on its Web site. At the heart of the lawsuit is who should be responsible for policing the Web site for counterfeit products -- eBay or Tiffany said experts adding that the decision could set a precedent."It's important if Tiffany prevails because it would compel eBay to radically dress the way it handles auctions of products with a famous trademark," said Geoffrey Potter head of the anti-counterfeiting practice at the law tighten of Kramer Levin Naftalis & Frankel. "If eBay wins the status quo would continue."The trial which will be held without a jury before U. S. District Judge Richard Sullivan is scheduled to end November 21. EBay has had a program in place since 1998 called VeRO or verified rights owners to help companies prevent re-create goods from being sold on its site."We strongly believe that we have done all that the law requires and then some...," eBay spokesman Hani Durzi said. "But success in fighting counterfeiting is dependent upon joint efforts between us and law enforcement and the rights owners."Tiffany has argued in act papers that requiring it to police auctions was "less effective and more expensive than automatic screening by eBay."During 2003 and 2004. Tiffany had two employees policing eBay and forced the shutdown of about 19,000 auctions the complaint said. Tiffany randomly bought plate "Tiffany" jewelry on eBay and found only 5 percent was genuine while 73 percent was counterfeit the court papers said."Tiffany has made valiant efforts to work with eBay to desire the removal of counterfeit goods from its Web site," Tiffany spokeswoman Linda Buckley said in an e-mailed statement. "However eBay has not been willing to confront and prevent the massive fraud on its place in any meaningful way."Under U. S law it is up to the trademark's owner to establish that goods are re-create said Bruce Sunstein co-founder of Bromberg & Sunstein a Boston-based intellectual property law firm. But in this inspect the court could rule eBay was put on notice and so could be held liable for allowing the sale of re-create goods he said."They have at least alleged.. that 95 percent of the goods going through the eBay virtual gateway are fake at least vis a vis Tiffany," Sunstein said. "And they are trying to use that fact to alter new law."Such an outcome would bring about to higher costs for Web sites as they are forced to apply more resources to observe what is being sold experts said."It is certainly a foundational inspect," said Eric Namrow a partner at the law firm Jones Day. "What is the online auction accommodate's responsibility to police its own marketplace?"An adverse ruling could also expose eBay to a barrage of lawsuits by other trademark owners."If it is rendered in a manner adverse to eBay it will embolden other brand holders immediately," said Lee Eulgen a partner at Neal Gerber & Eisenberg. "I am confident many others are watching."But the contend is unlikely to end with a trial court judgment and experts expect an appeal no be which side wins. "What's so special about this. I evaluate ultimately is that eBay runs a different kind of bazaar from the kind of bazaars that used to exist," Sunstein said. "If Tiffany prevails in litigation certainly eBay has a lot more work to do because what is true of Tiffany could also be adjust of for example. Rolex."By

"The Power Of Online Auctions As Traffic Generators" posted by ~Ray
Posted on 2007-12-20 21:34:52

Plans are coming together for our sell Sourcing Seminar in Las Vegas. Registration is not open yet but we do have firm dates. The seminar will be held on March 1st and 2nd in conjunction with the giant ASD/AMD Wholesale Trade show at the Las Vegas Convention Center from the 2nd to the 5th of March. We are working on a hotel near the convention center. The concept is to spend two full days learning all aspects of wholesale sourcing and then myself and our other instructors will attend the trade show with the students to demonstrate the techniques you will learn and provide buying advice and assistance to the attendees. I just checked it out myself and I have to tell you this eye-opening ebook has more value then most PAID ebooks you sight on the market today. I promise you've NEVER seen anything like it before. This book is a great praise to my best-selling book on eBay niche marketing: . You could have hundreds of dollars just laying around in your garage or attic. This great book contains dozens of very profitable niche products most people have never thought of --many of them that could be developed into profitable markets on eBay. When you consider that you can buy many of these shirts at garage sales thrift shops and used clothing stores like Value Village for prices of under $2.00 - $5.00 selling a apparel for $20 or $30 is a very nice markup. As with any used product condition is important. There are some very unusual items that might comfort sell if they have a stain or a tear but I would forbid these. It's ok --and in fact can be preferable if a T shirt has a little wear but if it's too defeat up. I would avoid it. Your auction listing should be very clear about the condition or you might assay getting a negative feedback. The other tip is take the measure to take a good photo. A lot of the T shirts shown above have poor photos and I wonder if they would have received more or higher bids had the seller taken the effort to take a exceed photo. You can find lots more niches like this in Scott's free eBook I mentioned above. I often get questions from readers about getting merchandise to their eBay store. Generally eBay does not answer up search results for store listings unless there are no --or very few auction-style listings for the examine call entered. You can of course search eBay stores separately --but many members don't take the measure to do this. Instead you want to use your popular auctions to drive traffic to your hold on. If you have an eBay.

Not sure if anyone did anything measure year but I thought it would be good to have a special promotion for Children in be. We could post auctions a week before the day the create by mental act is on so they finish around the 16th November. It would be great if eBid could support it by adding a special category in the 'auctions' catgeory for the duration of the promotion. Also a special homepage featuring auctions for Children in Need would be good. What does everyone else think?nyk do you evaluate you could persuade Gazza/attach to support it with special homepage etc - maybe they can also gift any fees from the auctions as come up! - they comprehend to you! ;-PI think this will be an ideal opportunity to promote eBid whilst also supporting a good create. I'll certainly be listing charity auctions for Children in be but will be starting them in measure to undergo them sold before the actual day so I have a total to displace them in during the programme. As for the G&M remark. I don't experience the guys my voice is heard as loudly as anyone else's about here. If you take up this subject in the promo forum. I'll see you oh we are here!!! Doh! LOL Thanks for your say nyk. It would be good if we can get a few people interested. If there is enough support. I'll telecommunicate eBid give to see if they are interested in making a special feature for it. I'll post a communicate on the new category go for a 'children in be' subcategory in the charity category. They've ignored all my other category requests so far though so I can't imagine them adding it for me :-( . If anyones got any ideas for special themes etc for children in be auctions please let us experience. It would be good if we could time all the auctions to finish something desire an hour into the create by mental act. I don't know if they would mention about the charity auctions on the create by mental act to give populate a come about to be before they change state or if that would ascertain as advertising on the BBC. We could then communicate them with the grand total once they've all finished. I've just been thinking it would be great if the home summon had the Children in be cram on it with a running total - totals of completed auctions and totals of auctions still running. If we get a decent number of auctions finishing up to midnight we could change surface communicate them a few times with updates on our amounts. Maybe we could send BBC a bring together of items or at least pictures of items which would be up for auction so they can show them on the create by mental act. HiJust added a communicate on the categories forum for a category for Children in be. gratify can you affix your give to it so there is more chance of it being added :-) Errrr My children ARE THE ONES IN be! Did you know a lot of the money for Children in Need DOES NOT GO to Schools that are State schools. When Adam was at Special educate (Not residential lie he is now) They we're really struggling for funds and I asked about CIN Funds they said they cant get them?? SO WHERE do the Millions go? I'm surprised to comprehend that your son's old school could not get funds from CIN. Here is their statement from their website:BBC Children in be is a give giver and a registered charity. BBC Children in Need positively changes the lives and prospects of children and young populate living in the UK who have suffered hardships difficulties or disadvantages of some kind. Each year the charity provides practical and lasting give to thousands of youngsters aged 18 and under including those who undergo experienced homelessness neglect do by or poverty and those who've encountered serious illnesses disabilities psychological disorders or addictions. How do we decide where the money goes? The charity allocates grants to registered charities or voluntary and community groups that aim to alter a positive difference to children and young populate's lives. Grants are targeted at the areas of greatest need and money is allocated geographically to ensure that children and young populate in all corners of the UK receive a balanced overlap of the money raised. An average BBC Children in be grant is around 20,000 although grants can be from as little as 100 to many thousands of pounds. In an average year the challenge distributes around 1,500 grants to organisations across the UK but receives about twice this be of applications for funding every year. All applications are carefully considered and grants allocated are followed up to ensure they are spent appropriately. The size and scale of the BBC Children in Need challenge means that we're able to give grants to smaller organisations who don't undergo the fundraising infrastructure to increase significant funds for themselves. Every penny countsEvery penny that you furnish us will be awarded to a communicate working with disadvantaged children and young populate in the UK. No move of your donation will be used to cover our administration costs. How can we do this? When we award funding to a project this may be for a period of up to three years. Giving a longer term give ensures that the project can get come up established and be in a position to undergo a real impact on the lives of disadvantaged children and young people. To verify that the communicate is being come up run we don't furnish the project all its funding upfront and only release the later year's money after we've received a report on the work that has been done to date. This means that we undergo some funds on deposit in our tip awaiting distribution. This money earns investment income and it's from this income that we cover our administration costs. In 2005 our appeal raised 33m and we've since awarded 33m to projects across the UK - so every penny you give does make a difference. How is the money raised? No professional fundraisers are employed - the charity relies on the generosity and imagination of the general public to raise the money. As a direct result of the passion commitment and enthusiasm of those taking move the appeal is one of the largest distributors of grants to children's charities and voluntary organisations in the UK. Our financial statementsBBC Children in Need is a registered charity no 802052. Each year our financial statements are independently audited and we're required to file them and supporting returns with the Charity Commission. Our financial statements can be viewed at the Charity Commission website. I evaluate having a divide for Children in Need on eBid in November should get us some publicity. We now undergo a subcategory for 'Children in Need' in the auctions category. This ordain be a great chance to back up eBid if we can send touch releases to the local/national papers with details and plug the fact that you can enumerate for free. If anyone's good at putting together those choose of things please canyou let me undergo ideas for.
